What is a restricted procedure?
The restricted procedure is a European procurement procedure consisting of two phases: a selection phase and an award phase. In the first phase, interested economic operators apply (request to participate). The contracting authority then selects the most suitable candidates, who are invited to submit a tender.
When to use?
The restricted procedure is suitable when the contracting authority wants to limit the number of tenderers, the contract is complex, specific expertise is required, or tender preparation costs are high.
The selection phase
The contracting authority publishes a notice and interested operators submit a request to participate with their UEA and evidence of suitability. Minimum period: 30 days. The authority assesses against exclusion grounds, suitability requirements, and selection criteria, selecting at least 5 candidates.
The award phase
Selected candidates receive an invitation to tender with full specifications. Minimum tender period: 25-30 days. Evaluation, award decision, and standstill period follow as in the open procedure.
Timeline
Total duration is typically 22-32 weeks, longer than the open procedure due to the two-phase structure.
