What is a competitive dialogue?
The competitive dialogue is a European procurement procedure specifically designed for complex contracts where the contracting authority cannot adequately define the technical specifications, legal setup, or financial conditions in advance. The procedure allows dialogue with selected participants to develop an optimal solution.
When to use?
The competitive dialogue may be used when the contracting authority cannot sufficiently define technical specifications, the legal setup requires customization, the financing structure needs tailoring, or innovative solutions are required.
Process steps
Phase 1: Selection
Similar to the restricted procedure, with at least 3 participants selected for dialogue.
Phase 2: Dialogue
The unique element: confidential discussions with each participant about technical solutions, risk allocation, financing, and contractual terms. Multiple rounds are possible.
Phase 3: Tender submission
After dialogue concludes, participants submit final tenders based on their presented solutions. Clarifications are allowed but no material changes.
Phase 4: Award
Evaluation against pre-announced criteria, standstill period, and contract conclusion.
Timeline
Total duration typically 34-68 weeks, significantly longer than standard procedures due to the dialogue phase.
