Use and responsibility

Tenderview.ai is an information and analysis platform. By using this platform, the user acknowledges being personally responsible for all entered data, queries, and interpretations of the results.

TenderNed is the official source

Tenderview.ai is a derived information product offering analyses, summaries and additional insights based on public procurement data. All legally binding publications, conditions, deadlines, amendments and award information are published on TenderNed (aanbestedingskalender.nl) and, for European tenders, in the EU Official Journal (TED). The user is at all times required to consult the primary source before submitting, deciding or taking contractual action. Tenderview.ai does not replace this consultation and cannot in any way be considered legally binding. Data may lag behind TenderNed. Tenderview.ai gives no guarantee that all amendments, addenda or withdrawals have been processed in time.

AI support and possible inaccuracies

Tenderview.ai uses AI technology to assist in analysing and summarising tender information. AI-generated results may be incomplete, incorrect, or outdated, and may contain so-called hallucinations. No rights can be derived from the results.

No legal or professional advice

The information and analyses offered through Tenderview.ai do not constitute legal, financial, or other professional advice. Users remain solely responsible for verifying information and making decisions based on it.

Sources and data

Tenderview.ai exclusively uses publicly accessible sources, including the TenderNed API and associated public procurement documents. Tenderview.ai is not responsible for the accuracy, completeness, or timeliness of this external source data.

Advisor functionality and processor role

When using the Advisor functionality (client dossiers, client pipelines, client reports), Tenderview.ai may process data about third parties on behalf and at the instruction of the advisor. In that capacity the advisor is the data controller under the GDPR and is independently responsible for: • a valid legal basis for processing the data of his/her clients, • informing the affected clients about the processing, • obtaining any required consent, • entering client data correctly and completely. Tenderview.ai (Bokpro B.V.) acts as a processor. A data processing agreement compliant with Article 28 GDPR is available on request via [email protected]. Using client dossiers without a valid legal basis or without the processing agreement is at the advisor's own risk.

Liability

To the extent permitted by law, any liability of Tenderview.ai (Bokpro B.V.) is excluded, in particular for: • missed submission deadlines, even if these were incorrectly or not displayed in the platform; • missed or undiscovered tenders via searches, alerts, recommendations or email notifications; • algorithmic rankings, matching scores, AI summaries, client suggestions or market analyses; • loss of profit, revenue loss, missed contracts or reputational damage; • unavailability, outages or delays in underlying sources (TenderNed, TED) or sub-processors (hosting, AI providers). Should liability nonetheless be established in a specific case, it is in all cases limited to fifty percent (50%) of the amount actually paid by the user to Tenderview.ai in the twelve (12) months preceding the damage-causing event. For users who have paid no or only an incidental fee, an absolute maximum of € 100 per event applies. This limitation does not apply to damage caused by intent or wilful recklessness of Tenderview.ai.
